Uniform Civil  Code

The uniform civil code is the law which provide one law for the entire country which is applicable to all regions communities in their personal matters such as a marriage, divorce inheritance adoption etc.

According to article 44 the state shall endeavour to secure a UCC for the citizen throughout the territory of India. DPSP is defined as article 37 are not justiciable not enforced by any court but the principle laid down therein are the fundamental in the governance.

India law do not follow a uniform code in most civil matter such as Indian Contract Act 1872 , Civil Procedure Code, Transfer of Property Act 1882 , Partnership Act 1932 , Evidence Act 1872. They have made hundred of Amendment and therefore in certain matters there is diversity even  under these secular civil laws.

The law commission of India is a non – statutory body constituted by the government of India from time to time  The first law commission of Independent India was established in 1955 for a three years time. The first law commission was established during British Raj in 1834 by the charter Act of 1833 was chaired Lord Macaulay.

The law commission undertakes research in law and review of existing law in India for making reforms there and enacting new legislation on a reference made to it by the central government.

Apart from having full time chairperson, the commission will have four full time members including a member secretary . The law and legislature secretaries in the law ministry will be the ex – offico members of the commission. It will also have not more than five part time members. A retired judge of Supreme court judge or chief  justice of high court will head the commission .

The law commission in its 262nd report recommended abolition of the death penalty for all crimes except terrorism – related offices and waging war against the state. It reports on electoral reforms (1999)  suggested in Lok Sabha and state assembly election to improve governance and stability.

The Criminal Procedure ( Identification ) Act , 2022 which replace the identification of Prison Act , 1920 was also proposed by the law commission of India. The 21st commission is recommendation in 2018 said that uniform civil code (UCC) is neither necessary was desirable at this stage. The center requested the 22nd law commission of India to undertake on various issues .
