Spousal rape or marital rape is the act of sexual contact with one’s life partner without the wife’s permission. In addition, any physical, mental, or verbal force must become into the category of violence.

Marital rape has been taken for granted in India. However, stories about marital rape continue to happen with frightening occurrences. Marital rape is more painful as wives are expected to love and care for their husbands than normal rape, where strangers rape the victim.

Dodges Of Indian Law

The Criminal Law (Rape) (Amendment) Act, 1990 removed the word “unlawful” from the 1981 definition of rape and abolished “any rule of law by which a husband cannot be guilty of the rape of his wife.” An Indian court is abortive in bringing a judgment in a case of marital rape. There is diversity among lawmakers about marital rape.

Marriage is a bond between two people who need love, respect, and care from each other.

Spousal rape is unregarded most of the time. Sufferers do not share their suffering with anyone due to shame and social stigma, making their lives miserable.

Lack Of Support From Family And Friends

Some of them share with their family, so the family suggested it’s normal it is happening with all rather than being supportive. They need to be more sensitive to understand and feel the pain victims go through. Victims also do not file complaints against their husbands due to social stigma.

Definition Of Marriage

Marriage is a bond between two people who need love, respect, and care from each other. If any relationship lacks these requirements, we must be aware of scrutinizing all the related aspects of marriage.

Spousal rape or marital rape is the act of sexual contact with one’s life partner without the wife’s permission.

Forcing the spouse, verbal abuse, and sexual abuse is part of exploitation, which also demolishes Article 14, a fundamental right as per the Indian constitution. Everyone should be treated similarly. The husband is dominating his wife in a way that she feels terror, pain, and trauma, so we cannot say that it is freedom.

Why People Need Marriage

We get married to live a life full of love and respect, and we need a companion with whom we can share our movements in life. But if we are getting something else that evokes fear and mental trauma, why do we need marriage?

We can’t imagine how painful this is without meeting the victims of marital rape. Marital rape is illegal in many countries as it was criminalized in Serbia in 2002, Thailand outlawed it in 2007, and many other countries.
