equality wins again

Supreme Court delivered it’s three back to back historical landmark judgements to address gender inequality  in India.  Again, equality win over inequality in a right way in India.

As now, supreme Court declared section 377  unconstitutional.  Before,  this judgment sexual identities of some people were seen as a crime against nature but finally,  this landmark  judgement can change their lives in a better way as now,  they will live and love their life with dignity.

Second,  landmark  judgement was about section 497 where supreme  Court criminalized section 497 (adultery in marriage) of the Indian Penal Code. Where supreme Court mark their judgment with a strong statement that Wife is NOT property of husband,  women can’t  be asked to think and do according to the will of the society.  Adultery laws affects the fundamental right to life and personal liberty of women but,  yes It can be ground for divorce but not a criminal  offense, as it dents the individuality of women. Women will have their own freedom in their marriages.  In my point of view it may be decrease the number of cases of martial rape in marriages.

Third,  Sabarimala  Temple verdict where again it was a victory of gender equality as on September 28, the Supreme  Court lifted the ban,  calling it a violation of women’s right to practice their faith.  However, Justice Indu Malhotra presented a dissenting judgment where she said that the issues of deep religions sentiments should not ordinarily be interfered by the court as the court should not interfere in religion.

But in my point of view individuals freedom and their rights should come first as right to worship is also applicable for women.
